Kramer, " Legally Expressed Will of the Invalid Resignation of BXVI"There are so many Catholics who do not grasp the principles of Canon Law, and therefore fail to understand invalidating force of a nullifying technicality, such as the nullifying technicality that invalidates the "renunciation" of Pope Benedict XVI. These clueless Catholics appeal to "common sense" on a matter in which true common sense invariably defers to the strict application of the principles of law. It is claimed that "we know what Pope Benedict really intended; it was his intention to step down and allow a successor to be elected pope". Such is the failure of what is perceived to be "common sense", because the detetmining factor of a juridical act is strictly the legally expressed will stated in the official act, and not the presumable and ostensible intention that is commonly perceived.
